1. About these terms

These Terms of Service ("Terms") govern your access to and use of the Pacer Build platform operated by PACERBUILD LTD ("Pacer Build", "we", "us", "our"), a company registered in England and Wales under company number 17483572. By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.

2. Definitions

• Platform - the Pacer Build website and services.
• Worker - an individual tradesperson who creates a profile to be matched to work.
• Contractor - a business or individual who posts labour requests to find workers.
• Matching engine - our system that scores and ranks workers against a contractor's request.

3. Eligibility

You must be at least 18 years old and, if registering as a worker, have the right to work in the United Kingdom. You are responsible for ensuring the information you provide to demonstrate this is true and current.

4. Accounts and verification

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials secure and for all activity under your account. Worker profiles, identity, right-to-work and certifications are subject to administrator verification; we may decline or revoke verification where information cannot be confirmed or is found to be false.

5. Worker obligations

• Provide accurate details of your trade, skills, certifications and availability.
• Hold and maintain valid, in-date certifications for the work you accept.
• Carry out work you accept professionally and safely, in line with applicable regulations.

6. Contractor obligations

• Provide accurate details of the work, location and rate in each request.
• Comply with all applicable employment, health and safety, and payment obligations toward workers you engage.
• Use worker data only to assess and manage the engagement, in line with our Privacy Policy.

7. The matching service

Pacer Build provides a platform that connects contractors and workers and ranks potential matches. We are not an employer, employment agency or employment business in respect of any engagement formed between a contractor and a worker, and we are not party to any contract of work between them. We do not guarantee that any request will result in a match, that any worker will be hired, or any particular outcome, quality or availability. The engagement, including pay, supervision and compliance, is between the contractor and the worker.

8. Fees and payments

Any fees for using the platform will be set out to you before they apply. Where payments are processed through the platform, they are handled by our third-party payment processor, Stripe, subject to Stripe's terms.

9. Acceptable use

You agree not to:

• provide false, misleading or fraudulent information, including false credentials;
• use the platform for any unlawful purpose or to circumvent verification;
• misuse, scrape, or attempt to gain unauthorised access to the platform or other users' data;
• interfere with the operation or security of the platform.

10. Intellectual property

The platform, its content and branding are owned by or licensed to Pacer Build and are protected by law. You retain ownership of the content you submit, and grant us a licence to use it to operate and provide the service.

11. Disclaimers and liability

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss, loss of profit, or loss arising from an engagement between a contractor and a worker. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

12. Indemnity

You agree to indemnify Pacer Build against claims, losses and costs arising from your breach of these Terms or your misuse of the platform.

13. Suspension and termination

You may close your account at any time. We may suspend or terminate access where you breach these Terms, where verification cannot be maintained, or where required by law. Provisions that by their nature should survive termination will do so.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.

15. Changes

We may update these Terms from time to time. We will post the revised version here and update the date above. Continued use of the platform after changes take effect constitutes acceptance.
