Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pacer Build platform operated by Pacer Build Ltd ("Pacer Build", "we", "us"). By creating an account or using the platform, you agree to these Terms. If you do not agree, please do not use the platform.

1. The platform

Pacer Build is a UK construction workforce platform that connects contractors and homeowners with construction workers. We provide profile verification, a rule-based matching engine, job posting and assignment tools, ratings, and hours logging. Pacer Build is a technology platform: we facilitate connections between parties but are not the employer of any worker and are not a party to the work arrangements agreed between users.

2. Accounts and eligibility

You must provide accurate information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your login details and for all activity under your account. You must be at least 18 years old and legally able to enter into these Terms. Worker accounts are subject to identity, right-to-work and certification verification by our administrators.

3. Worker responsibilities

Workers are responsible for the accuracy of their profile, skills, certifications and compliance information, and for holding the valid qualifications and right to work they claim. Verification by Pacer Build supports trust on the platform but does not transfer legal responsibility for a worker’s eligibility, conduct or work quality away from the worker.

4. Contractor and homeowner responsibilities

Contractors and homeowners are responsible for their own hiring decisions, for complying with applicable employment, tax and health and safety law, for verifying that a worker is suitable for their site or job, and for paying workers as agreed. Contractors remain responsible for their own obligations, including where relevant those under CIS and IR35. Pacer Build does not provide legal, tax or employment advice.

5. Matching and verification

Our matching engine ranks workers against a job using transparent, rule-based scoring across factors such as trade, distance, availability, verification, skills, certifications and track record. Match scores are a decision aid, not a guarantee of suitability, quality or outcome. You remain responsible for your own assessment before engaging any worker.

6. Commission and fees

Where a commission applies, a contractor agrees to the applicable commission rate before posting jobs, and commission becomes payable to Pacer Build Ltd on completed deployments as set out at the point of acceptance. Homeowner-posted jobs may operate under different terms. Certain payment features may be in test mode or limited while payment processing and related compliance are being finalised, and this will be made clear in the relevant part of the platform.

7. Hours logging

Hours recorded on the platform are self-reported by workers and are provided for monitoring and record-keeping. They are not independently verified attendance. Contractors may review, approve or flag logged hours. Users are responsible for agreeing and confirming actual hours and pay between themselves.

8. Acceptable use

You agree not to:

  • Provide false, misleading or fraudulent information.
  • Impersonate another person or misrepresent your credentials.
  • Use the platform for any unlawful purpose.
  • Attempt to disrupt, compromise or misuse the platform or its security.
  • Collect or misuse other users’ personal data.

We may suspend or remove accounts that breach these Terms.

9. Data protection

Our handling of your personal data is described in our Privacy Policy. By using the platform you acknowledge that policy. We take reasonable measures to protect data, including encrypting sensitive identifiers at rest, but no system can be guaranteed completely secure.

10. Availability and changes

We aim to keep the platform available and reliable but do not guarantee uninterrupted access. We may update, change or discontinue features, and we may revise these Terms from time to time. When we update the Terms, we will revise the "last updated" date above, and continued use of the platform means you accept the updated Terms.

11. Liability

To the extent permitted by law, Pacer Build is not liable for the acts, omissions, conduct, work quality or eligibility of any user, nor for the outcome of any job, engagement or payment arranged between users. The platform is provided on a reasonable-efforts basis. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, unless otherwise required by applicable law.
